Copyrights/Where the archives are

One point to ponder. Is an ad considered public domain? The original
artwork belongs to IH (actually, the Ohio or was it Illinois, state
university archives or whoever CASE gave the IH archives to). The act of
digitizing an image constitutes real work, but does National Geographic
generate a copyright interest by duplicating (into electronic) a public
domain work? The images are accessible in a public domain standard
(.JPG), so no special software is required to view the images. The
articles, National Geographic obviously has copyright on. But I'd doubt
on the ads. Anyone know?

Since we are in contact with Navistar (International) on a fairly 
regular basis, let me clarify where the archive materials for what 
are located.

First, when Case (Tenneco at the time) purchased the Ag Division from 
what was then Harvester, they did not get any archival materials from 
International. Those remained with International in Chicage, Ill. 
Several years ago Navistar decided to dontate materials not relating 
to the truck business to the State Historical Society of Wisconsin, 
located in Madison. This is where the archives are located. They have 
their own web site. 
Truck, Scout pickup, Travelall, Auto Wagon, etc stuff resides at 
Navistar in Chicage in their archives. In order to reproduce any 
truck related materials or use any trademarks, you must be licensed 
by Navistar. This includes the Scout name, and all logos such as the 
"IHC", "Triple Diamond", "IH" "International", "International 
Harvester", etc. 
If you are to use the "IH", "IHC" or "International Harvester" 
trademarks or materials relating to farm equipment, you must be 
licensed by Case Corporation, in Racine Wisconsin. 
Advertising is not considered public domain. Depending on the 
agreement with the particular publication at the time, the ad may 
belong to the company, or in some cases, the publication itself.
It just depends on the agreement.
